Relaxtay – Terms & Conditions

1. Acceptance of Terms

By accessing and using the Relaxtay direct booking website (the “Site”), you agree to comply with and be legally bound by these Terms and Conditions, as well as any additional policies, house rules, or property-specific terms disclosed during the booking process or listed on the applicable property page. If you do not agree to these Terms, you must refrain from using the Site or making a reservation.

 

2. Definitions

“We,” “our,” “us” refer to Relaxtay Inc.

 

“You,” “your,” “guest” refer to the individual making the booking and all members of their party.

 

“Services” refer to booking services, accommodations, experiences, amenities, and related offerings provided through the Site.

 

“Property” refers to any accommodation listed under the Relaxtay brand.

 

3. Booking Eligibility & Screening

3.1 Minimum Age

The primary booking guest must be at least 21 years of age and must remain responsible for all occupants and any approved visitors throughout the stay.

 

3.2 Reservation Accuracy

All information provided during the booking process must be accurate, complete, and truthful. Any misrepresentation constitutes a material breach of these Terms.

 

3.3 Reservation Screening & Conditional Acceptance

All reservations are subject to automated and manual screening using third-party verification, fraud prevention, and risk assessment systems.

 

Relaxtay reserves the right, at its sole discretion, to cancel a reservation within twenty four (24) hours of confirmation if the reservation is identified as high-risk, suspicious, fraudulent, or otherwise unsuitable, with or without providing a reason.

 

After this screening period, Relaxtay will honor confirmed reservations except in cases of force majeure, safety concerns, or circumstances beyond our control.

 

4. Property-Specific Rules & Guest Conduct

4.1 House Rules & Occupancy

Each property has its own house rules, maximum occupancy limits, event policies, amenity guidelines, and behavioral expectations, which are clearly disclosed on the specific property listing and/or in pre-arrival communications. By booking, you agree to strictly comply with the rules applicable to the property you reserved.

 

4.2 Events, Parties & Gatherings

Certain properties may allow events or gatherings only with prior written approval from Relaxtay. Approval is granted on a case-by-case basis and may require additional agreements, deposits, documentation, or fees.

Unauthorized events or gatherings are strictly prohibited and constitute grounds for immediate termination of the reservation without refund.

 

4.3 Visitors & Guest Registration

Only registered guests listed on the reservation are permitted on the property. Unregistered guests or visitors are not allowed under any circumstances unless explicitly approved in writing by Relaxtay.

 

4.4 Smoking

Smoking or vaping of any kind is prohibited inside all properties unless explicitly stated otherwise in the property listing. Violations may result in substantial cleaning fees, damage charges, and immediate termination of the stay.

 

4.5 Pets

Pet policies vary by property. Guests must comply with the pet policy stated on the specific property listing. Unauthorized pets may result in additional fees, damages, or termination of the reservation without refund.

 

5. Check-In & Check-Out

Check-In: 4:00 PM (local time)

 

Check-Out: 10:00 AM (local time)

 

Early check-in or late check-out is not permitted unless explicitly approved in writing in advance. Unauthorized late check-outs may result in additional fees and/or removal of belongings.

 

6. Payments, Security Deposits & Post-Stay Charges

6.1 Payments

Payment terms vary by property and booking type and are disclosed during the booking process.

 

6.2 Security Deposits & Authorization Holds

Relaxtay reserves the right to place security deposits or authorization holds on the payment method on file.

 

6.3 Damage, Cleaning & Rule Violation Charges

You expressly authorize Relaxtay to charge the payment method on file for damages, missing items, excessive cleaning, rule violations, unauthorized guests, unauthorized events, smoking violations, pet violations, overstays, or any other costs incurred as a result of your stay. Charges may be processed after checkout if issues are discovered post-departure.

 

7. Cancellations & Refunds

All reservations made through the Relaxtay direct booking website are subject to the following strict cancellation policy, regardless of reason, including personal circumstances, travel issues, illness, weather concerns, or changes in plans.

 

7.1 Cancellation Timeline

Within 30 days of check-in:

No cancellations permitted. No refunds issued.

 

31 to 60 days prior to check-in:

50% of the accommodation cost is refundable. The remaining 50% is non-refundable.

 

More than 60 days prior to check-in:

100% of the accommodation cost is refundable, subject to applicable fees.

 

7.2 Processing & Handling Fee

All refunds are subject to a mandatory 5% processing and handling fee, which is non-refundable under all circumstances. This fee applies even to fully refundable reservations.

 

7.3 Refund Processing

Approved refunds are processed within a reasonable timeframe. Actual receipt of funds depends on banks and payment processors and is outside of Relaxtay’s control.

 

7.4 No Exceptions

No exceptions will be made to this cancellation policy for weather events, travel delays, illness, emergencies, or acts of God, except where required by applicable law or expressly approved in writing by Relaxtay.

 

8. No Chargebacks / Payment Disputes

By completing a reservation, you agree not to initiate chargebacks or payment disputes for any charges authorized under these Terms. Any chargeback submitted in violation of this section constitutes a breach of contract and may result in additional fees, collections, and legal action.

 

9. Surveillance & Property Monitoring

Properties may be equipped with exterior security cameras, noise monitoring devices, or other lawful monitoring systems designed to protect the property and ensure compliance with house rules. No cameras are placed inside properties or in private interior spaces. By booking, you consent to such monitoring.

 

10. Experiences & Amenities – Use at Own Risk

Pools, hot tubs, saunas, gyms, trails, fireplaces, water features, and recreational amenities are used entirely at your own risk. No lifeguards or on-site supervision are provided. You assume all risk of injury, loss, or damage arising from use of these amenities.

 

11. Limitation of Liability

To the fullest extent permitted by law, Relaxtay shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use of the Site, the Services, or any stay at a property, including but not limited to personal injury, loss, theft, or property damage.

 

12. Release & Waiver of Claims

By booking and staying at a Relaxtay property, you hereby release, waive, and forever discharge Relaxtay Inc., its affiliates, owners, officers, employees, agents, and property owners from any and all claims, demands, or causes of action, known or unknown, arising from or related to your stay, including those caused by negligence.

 

13. Indemnification

You agree to indemnify, defend, and hold harmless Relaxtay Inc. and its affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from your stay, your guests, violations of these Terms, damage to property, or injury to any person.

 

14. Force Majeure

Relaxtay shall not be liable for any delay, cancellation, or failure to perform resulting from events beyond its reasonable control, including but not limited to natural disasters, severe weather, power outages, fires, floods, government actions, or other acts of God.

 

15. Right to Refuse Service & Termination

Relaxtay reserves the right to refuse service, cancel reservations, or terminate stays at any time, with or without notice, for violations of these Terms, misrepresentation, safety concerns, or inappropriate conduct. In such cases, no refund will be issued.

 

16. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in the State of New York.

 

17. Intellectual Property

All content, trademarks, logos, text, images, and materials on the Site are the exclusive property of Relaxtay Inc. and may not be used, reproduced, or distributed without prior written consent.
